Please note: these are current as at July 2014 and, whilst we endeavour to keep to these fees, they can be an estimate only as developments in your matter may dictate extra work and searches. Usually these fees are reviewed after 1 July in each year subsequent to changes in government and council search, registration and filing fees.
Purchasing Houses and Land
An estimate of our Professional Fees and Searches (including GST) for a standard non-complicated purchase in Ipswich is $1,579. Please contact us for our fees and outlays in other Council areas.
This covers an initial title search, registered plan of the land (not the house), transport department search, land tax search, Council search (not a building records search), water reading and check search on the settlement day. If you or your financier require further searches then this will increase the fees and outlays and you will need to discuss this with us.
These fees do not cover a settlement notice which some banks require to be lodged, body corporate searches, ASIC (for a company), QCAT (for neighbour and tree disputes), PPSR search (to check if any personal property included in the sale is subject to a charge) and easement search. Should you require any of these, please contact us.
There is also Transfer Duty to pay on the purchase – exactly how much depends on several variables. We need to know the purchase price, if you are going to live in the house then if it is your first home or not, if it is an investment house or vacant land (and if so, if you intent to build your first home on the land). Other complications are one buyer being a first home owner and the other not or the land is not all used for a residence for the buyers for example a business is run on part of the land or a farm with a residence that you intend to live in. If it is straightforward then send us an e-mail and we may be able to calculate Transfer Duty for you but if you have any doubt, please ring us.
If you are paying cash or your bank is not taking a mortgage on the property then you will also have to pay registration fees so that we can lodge the transfer in the titles office.
Selling Houses and Land
Our estimated Professional Fees for a standard non-complicated sale are $594 plus title search of $27.05. If other searches are required then we will contact you to discuss these.
Wills and Powers of Attorney
Professional Fees (including GST) $132 each document – please note this is an Internet special if instructions are submitted via the form on the left hand side of the Wills page.
If it is required to use the Power of Attorney to deal with land in the Department of Environment and Resource Management (Titles Office) then this must be registered separately and there are extra professional and registration fees to pay.
Business and Lease Matters
We act for clients wishing to purchase or sell a business, preparing leases of business premises and advising on entering into leases.
Our Professional Fees (including GST) are $880 plus Process Service fees (if needed) of about $110 and Court Filing fees of $845. If you don’t have your marriage certificate then you will need to pay for this as well.
Other Family Law
This includes property settlements and children’s issues for both married and de facto couples.
This covers all criminal charges. We do not act for legally aided criminal law clients.
Drink Driving & Work Licence Applications
We act for clients where they lose their licence due to drink driving and require a driver’s licence for work.
Our estimated Professional Fees (including GST) are $1,320.
